Lack of Verification & Fraud Found in Asbestos/Silica Case

As the New York Times reported, the litigation determined that two physicians diagnosed more than 90 percent of the plaintiffs as having silicosis, and the same doctors had diagnosed many of them as having asbestosis. When questioned before the court, several doctors withdrew their diagnoses and said they had not interviewed the claimants and for some did not even see their X-rays. Judge Jack called the withdrawing of diagnoses “a fraudulent problem.” Silica Products Liability Litigation, MCL docket No. 1553
